  1. SAFETY REQUIREMENTS FOR EACH LOCATION INCLUDE :
  • I.C.C. Common Consumer Class C 1.4G fireworks ONLY may be sold.
  • NO bottle rockets may be sold per Chapter 11-51(g).
  • NO aerial devices that utilize a straight and rigid stick attached to a propellant tube or driver will be sold, distributed, possessed or discharged within the city limits per Chapter 11-51(t).
  • There shall be NO SALE, USE, or STORAGE of fireworks near any flammable substance or hazardous location as determined by the Fire Inspector.
  • NO fireworks may be sold within six hundred feet (600’) of any church, school, or hospital.
  • NO fireworks may be sold within twenty-five feet (25’) of any brick building, nor within fifty feet (50’) of any building not of masonry construction.
  • NEW – NO motor vehicle shall be parked within ten feet of a seasonal retail sales location.
  • NO fireworks may be stored, kept, sold or discharged within one hundred feet (100’) of any gasoline pump, filling station, bulk station, or any building in which volatile liquids are sold in quantities in excess of one (1) gallon.
  • NO fireworks will be discharged within three hundred feet (300’) of ANY retail sale location.
  • NO fireworks may be sold to children under the age of seventeen years (17), or to any intoxicated or irresponsible person.
  • NO SMOKING signs, with letters at least 4” in height, shall be posted at a minimum of two (2) locations, one at each entrance.
  • NO smoking or carrying of a lighted pipe, cigar, cigarette, or other tobacco product will be permitted within fifty feet (50’) of any fireworks stand.
  • NEW - Each stand location that is over two hundred square feet (200’) shall have two (2) fire extinguishers mounted in plan view.  One (1) shall be a minimum 2A/20BC rated and one (1) shall be a pressurized water type.
  • If a stand is less than two hundred square feet (200’) it shall have a minimum of one (1) fire extinguisher with a minimum of a 2A rating.
  • NEW - The maximum travel distance to any fire extinguisher in a stand shall be no greater than thirty-five (35’).
  • NEW - A minimum of two remote exits shall be located in seasonal retail sales locations.  The openings shall not be less than forty-four inches (44”) and the maximum travel distance shall not exceed thirty-five feet (35’).
  • NEW - Dead-end aisles are prohibited.
  • NEW - At least one sign that states “NO FIREWORKS DISCHARGED WITHIN 100 FEET” in letters that are four inches (4”) high and on a contrasting background, shall be posted at each entrance. 
  1. ELECTRICAL SAFETY REQUIREMENTS FOR EACH LOCATION INCLUDE, BUT NOT LIMITED TO, THE FOLLOWING:
  • All receptacles, light fixtures, appliances and extension cords shall be weather proof and grounded, and be approved for exterior use.
  • All lamps for general illumination shall be protected from accidental contact or breakage by a suitable fixture or lampholder with a guard.
  • NO electrical wiring shall be mounted to a metal post of pole.  Wiring must be separated from any contact with metal by either wood, glass or rubber.
  • Lampholders over tables and work benches containing fireworks shall be

of the unswitched type and shall be located at least eight feet (8’) above the floor.

  • Flexible cords and cables shall be protected from damage.  Avoid sharp corners and projections.  Protection shall be provided to prevent damage at pinch points and traffic areas.
  • All 125 volt single phase above ground 15 and 20 ampere receptacle outlet shall have ground-fault circuit interrupter (GFI) protection.
  • NEW - The power distribution panel shall be properly grounded with a minimum #6 solid copper wire connected to a copper clad ground rod.
  • NEW - Emergency lighting shall be required in seasonal retail sales locations when the retail area is larger than eight hundred square feet (800’).  Not required in tents or stands that are NOT OPEN for business after dusk.
  • NEW - EXIT signage shall be required to be self-illuminating, or internally or externally illuminated.  Not required in tents or stands that are NOT OPEN for business after dusk.

  1. THE FOLLOWING IS A LIST OF DATES AND HOURS FOR THE RETAIL SALE AND USE OF FIREWORKS PER CHAPTER 11 SECTION 11-52 IN THE CITY CODE OF ORDINANCES:
  • Sale:  Fire works may be sold between the hours of 8:00 A.M. and 10:00 P.M. each day from June 27th to July 4th of each year.  On July 4th fireworks MAY NOT be sold after 10:00 P.M.
  • Use:  Fire works may be used between the hours of 10:00 A.M. and 10:00 P. M. each day from June 27th to July 3rd.  On July 4th fireworks may be used between the hours 10:00 A.M. and 12:00 P.M. midnight.
  1. PENALTIES FOR THE VIOLATION OF ANY OF THE CODE OF ORDINANCES FOR THE CITY OF CAPE GIRARDEAU, CHAPTER 11, SECTION 11-54:
  • Violation of any of the provisions of this article shall also cause an immediate and automatic revocation of all licenses or permits.  The violator shall be prohibited from selling fireworks within the city for a period of two (2) years.
  • Any violation which involves the sale or use of fireworks other than permissible fireworks shall cause an immediate forfeiture of that merchandise to the city. 
  1. AN INSPECTION OF YOUR RETAIL SALES LOCATION IS REQUIRED TO ASSURE COMPLIANCE WITH CITY CODES.  THE FIRE DEPARTMENT WILL MAKE A FINAL INSPECTION OF YOUR LOCATION(S) BEFORE ISSUANCE OF YOUR CITY MERCHANT LICENSE.
  • Your retail sales location may also be inspected by a representative of the Missouri State Fire Marshal’s office.

This is only a summary of the Ordinances of the City of Cape Girardeau.  For a complete understanding of these ordinances, see Chapter 11 of the Cape Girardeau Code of Ordinances.  A copy of the Ordinances is available at the Cape Public Library, located at 711 North Clark Street.

 

Each dealer, wholesale or retail, is required to have a Merchant’s License issued by the City Collector.  You will also be required to obtain a State Permit and a County Merchant’s License to sale fireworks.  The following is a list of offices that can assist you in obtaining your licenses and permits.

The fee is $10.00 plus gross receipts tax of $1.00 per $1,000.00 of gross receipts.  The fee covers the first $10,000.00 of gross receipts.
