The Planning Services Division manages several types of projects. In an effort to expedite the review process, the division's various applications can be found and downloaded for completion.
Completed forms, with all required supporting documentation and fees, should be returned by the appropriate deadline to the Planning Services Office, 401 Independence Street, Cape Girardeau, MO 63703.

Annexation Application
Property outside of the City limits may be annexed into the City at the request of the property owner and upon approval by the City Council. Upon annexation, properties gain access to City services of water, sanitary sewer, Police and Fire protection, solid waster service and more. Annexation does not change the school or library district. The property does change from the County Fire protection district to City protection. Property taxes typically go up 2% to 3% with annexation. Persons interested in annexation should contact the Planning Services Divsion.

Petition for Protest Form
Anyone may attend any public hearing held by the Planning and Zoning Commission and the City Council on rezoning any property. Anyone may ask questions and express their opinions on the rezoning request. Sec. 30-206(i) of the City Code provides for a protest against any amendment to a zoning district by adjacent property owners. A protest must be signed and acknowledged by the owners of thirty (30) percent or more of property within one hundred and eighty-five (185) feet of the boundaries of the proposed amendment. If a valid protest is received by the City, then the proposed amendment must be approved by two-thirds of the City Council - or five of the seven Council members.

Rezoning Application
When the proposed use of a property is not allowed under the current zoning of the property, it may be appropriate to rezone the property.In order to rezone a property within the city limits of Cape Girardeau, a rezoning application is submitted to the Planning Services Division. Planning staff reviews each application on an individual basis looking at the existing surrounding zoning and the appropriateness of the proposed use in relation to existing uses in the surrounding area. The application is then presented to the Planning and Zoning Commission, which meets the second Wednesday of every month. The Planning and Zoning Commission make a recommenation on the rezoning request to the City Council. A public hearing is held at the next City Council meeting and the City Council grants or denies the rezoning request.
The deadline for subimitting an application for rezoning is three weeks prior to the Planning and Zoning Commission meeting. There is a $126.00 publication fee associated with this application.

Special Use Permit Application

Subdivision Application
Property may be subdivided at the owners request. Property can be joined together or divided in order to meet the desired use of the property as long as it conforms to City Code. The application along with approved subdivision plats are presented to the Planning and Zoning Commission, which meets the second Wednesday every month. The Planning and Zoning Commission makes a recommendation on the request to the City Council. The City Council may grant or deny the subdivision request.
The deadline for submitting a subdivision application is three weeks prior to the Planning and Zoning Commission meeting. There is a review fee of $18 per lot in One or Two Family Residential Districts, $18 per unit in Multi-family Residential Districts, or $18 per acre in Commercial and Industrial Districts. The minimum review fee is $90.

Variance Application
Deviations from the requirements of the Development Code may be granted by the Planning and Zoning Commission. The application along with other pertinent information is presented to the Planning and Zoning Commission, which meets the second Wednesday every month. The Planning and Zoning Commission may impose conditions in the granting of the variances to insure compliance and to protect adjacent property owners.
The deadline for submitting an application for a variance request is three weeks prior to the Planning and Zoning Commission meeting. There is a $50.00 filing fee associated with this application.
